CNOSF: Nearly 70% of 386 conciliations led to agreements in 2013

Nearly 70% of the 386 conciliations led by the CNOSF (French Olympic Committee) resulted in agreements between the disputing parties, the CNOSF told News Tank on 17/07/2014.

Article L.141-4 of the Code du sport (the part of French civil code dealing with sports) states that any litigation between government-recognised federations and their affiliated sports clubs must go through the CNOSF's conciliation procedure. The body requesting such a conciliation must have a direct and personal interest in the affair.

At the conciliations, the two sides try to reach an agreement with the help of a CNOSF conciliator. If no agreement is reached, the conciliator then makes a settlement proposal that is "based in law and in equity" (equity as well as sports ethics play important roles in conciliators' assessments), the CNOSF said. If the proposal is accepted, the agreement goes into effect immediately. In case of disagreement, the parties may resort to the courts (the Administrative Court, the Administrative Court of Appeal, and the Council of State).
