Serie A TIM: Italian Competition & Market Authority (AGCM) fines DAZN (€7.2m) & TIM (€760,777)

"The Italian Competition and Market Authority (AGCM) has closed its investigation into certain clauses of the agreement between TIM and DAZN on the broadcasting of Serie A TIM football matches for the three-year period 2021-2024. Based on the revenues deriving to the two companies from the marketing of TV rights for the 2021-2022 season, the Authority has fined TIM €760,776.82 and DAZN €7,240,250.84," announced the AGCM on 13/07/2023.

The OTT platform DAZN had signed an exclusive agreement with Telecom Italia (for its TIM brand) for the acquisition of the Serie A TIM broadcasting rights in Italy for €840m per season over the 2021-2024 cycle. Telecom Italia would have guaranteed 40% of the amount paid by DAZN (i.e. around €336m) in order for TIM to be "the reference telephone and pay-TV operator for the DAZN content offering in Italy as well as for the technological partnership" during the 2021-22 season.

This agreement became non-exclusive from the 2022-23 season. As a result, the pay-TV operator Sky Italia entered into a distribution agreement with DAZN in Italy on 04/08/2022. TIM…
