CJEU ruling: "It's up to the social partners to act" (Jérôme Perlemuter, World Leagues Association)

"The transfer system is closely linked to employment law. It governs the relationship between a club and a player, in other words an employer and an employee. The social partners must therefore be included in any form of transfer management," said Jérôme Perlemuter (FRA), general secretary of the World Leagues Association, to News Tank Football on 16/10/2024.

Certain rules contained in FIFA's Regulations on the Status and Transfer of Players "hinder the free movement of players", restrict "competition between clubs" and are therefore "contrary to EU law," announced the Court of Justice of the European Union (CJEU), which handed down its judgment on 04/10/2024 after receiving a reference for a preliminary ruling from the Mons Court of Appeal (BEL) in proceedings between former French international Lassana Diarra and the International Federation.

"It is important to clarify that the Court of Justice's decision does not change the core principles of the transfer system at all," commented Emilio Garcia, chief legal and compliance officer at FIFA.
